Any extra materials requested by Party A which were not in the original design must be paid for by Party A. 2. 甲方提供的材料：另拟补充附件甲方负责采购供应的材9、料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙方负责保管 Material provided by Party A: (see the annex: “Table of Materials to be provided by the Owner”). If Party A acquires materials for the project, it should first check with Party B that the10、 materials match to the design requirements, and once the materials are in the care of Party B, then Party B is responsible for the materials. If Party A requires some materials which do not fit to the design then it shall be the responsibility of Party A to pay any additional costs incurred by Part11、y B. 四、关于工程质量及验收的约定FULFILMENT OF THIS AGREEMENT 1. 本工程应符合和市建设行政主管部门制定的其它地方标准质量评定验收标准The execution of this project must be consistent with the “Architectural and Engineering Rules” of the city administrative departments responsible for the development of buildings and local standards and quality eval12、uation acceptance criteria. 2. 本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认Party B must provide a duplicate copy of the construction designs and drawings, and both copies should be signed by both parties. 3. 甲方提供的材料、设备质量不合格而影响工程质量，其返工费用由甲方承担，工期相应顺延If materials provided by Party A for the construction do not meet th13、e necessary requirements, Party A shall bear responsibility for any resulting delays in the completion in the project. 4. 由于乙方原因造成质量事故，其返工费用由乙方承担If the quality of Party Bs work results in any accidents, the liability for such accidents shall be the responsibility of Party B.5. 在施工过程中，甲方提出设计修改意见及增减工程14、项目，须提前与乙方联系，在双方签订后，方能进行该项目的施工、因此影响工程竣工日期的，责任由甲方承担。凡甲方私自与施工人员商定更改施工内容、增加施工项目所引起的一切后果，甲方自负，给乙方造成损失的，甲方应予赔偿If, during the construction, Party A wishes to propose a change to the design, he should sign a “Change of Project” with Party B and must assume responsibility for resulting delays or increase in 15、costs. If Party A secretly attempts to change to design directly with the construction personnel and this action causes loss to Party B, then Party A must compensate Party B for this loss. 6. 工程验收：乙方负责理隐蔽工程和中间工程的检查与验收手续。由乙方组织专门人员进行验收。一切理隐蔽工程和中间工程的质量由乙方负责The standard of work. It is the responsibility16、 of Party B to make sure that all construction works are carried out to the requirements of the design and to make sure that all internal walls and hidden construction parts are to the required standard. 7. 工程竣工：乙方完工后即应通知甲方验收，甲方应在竣工当日组织验收，并办理验收移交手续，双方签。如果甲方在规定时间内不能组织验收，须及时通知乙方，另定验收日期。如通过竣工验 收，甲方应承认原17、竣工日期，并承担因此造成的乙方的看管费用和其他相关费用Project completion. Party B must notify Party A when the project is complete and ready for inspection by Party A. After inspection both parties must sign an “Engineering Quality Acceptance” document. If Party A is not available to inspect the construction site on the compl18、etion date, he must notify Party B of the soonest available date. Where Party A is not available on the completion date to retake custody of the location, he must pay any extra costs incurred by Party B. 8. 工程保修期一年。工程竣工验收后甲、乙双方签署，凭保修单实行保修，保修期一年，从竣工验收签章之日起算One year warranty. After completion of the w19、ork and signing of the “Single Warranty”, there shall be a one year warranty on the construction.五、有关安全生产和防火的约定SAFE PRODUCTION AND FIRE REGULATIONS1. 施工图纸和施工说明应符合防火 防事故的要求，主要包括电气线路等管道畅通、合格。乙方在施工中应采取必要的安全防护和消防措施，保障作业人员及相邻关系的安全,防止相邻单位的管道堵塞、渗漏水、停电、物品毁坏等事故发生 Construction drawings and construction must b20、e in line with fire prevention regulations, and accident prevention requirements. Party B shall take measures to ensure the safety of workers and neighbors at the constructions site and must prevent leakage of water, interruptions of power and damage 21、to property. 2. 施工中凡涉及改变房屋结构，拆、改承重墙，加大楼（地）面荷载，由甲方向物业管理部门提出申请，经所在地建设行政主管部门批准后方能施工Any changes to the housing structure or demolition or alteration to load bearing walls or increase in floor load must first be approved by the building property management before construction begins. 3. 双方款项往来均应出具正规收据和发票22、，以备查验和结算Both parties must provide money exchange receipts and invoices. 六、 其它事项OTHER MATTERS1.甲方工作Party A 1. 甲方应在开工前确认施工图纸并腾出足够的施工空间，以清除影响施工的障碍物。甲方向乙方提供施工需用的水、电等必备条件，并说明使用注意事项When Party A confirms the pre-construction and construction drawings, he must also make sure there is sufficient space availa23、ble at the construction site for construction to take place. Party A must make sure that Party B has everything necessary on site for completion of the construction, particularly electricity and water.2. 做好施工中因临时使用公用部位操作影响邻里关系等的协调工作Party A must take care of the public relations in the construction s24、ite area particularly with the neighbors. 2. 乙方工作 Party B1. 参加甲方召集的现场交底Party B must be available to attend meetings organized by Party A. 2. 乙方按要求组织施工，保质、保量、按期完成施工任务Party B must follow the construction plans, and the construction must be durable, and must meet the scheduled completion date. 七、违约责任LI25、ABILITY FOR BREACH OF CONTRACT1. 由于甲方原因导致延期开工或中途停工，工期顺延If Party A causes any delays to the completion of this project, then the scheduled completion date should be adjusted accordingly. 2. 由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造价0.1(大写:千分之一)的违约金If Party B causes any delay to the completion of this project, the26、n Party B must pay to Party A a fee of 0.1( in words: 1/1000)of the total overall project fee for each day beyond the scheduled completion date.3. 甲方未办理有关手续，强行要求乙方拆改原有建筑承重结构及共用设备管线，由此发生的损失或事故（包括罚款）由甲方负责并承担责任 If Party A instructs Party B to make any alterations to a load bearing wall and Party A has 27、not sought and received permission from the building property management, Party A shall be responsible for any resulting costs and shall indemnify Party B for any additional expenses incurred. 4. 乙方擅自拆改原有建筑承重结构或共用设备管线，由此发生的损失或事故（包括罚款），由乙方负责并承担责任If Party B makes any unauthorized changes to load beari28、ng walls or building pipelines and such changes result in damages or loss, it shall be the responsibility of Party B to pay for such loss.5. 工程未办理验收、结算手续，甲方提前使用或擅自动用工程成品由此造成无法验收和损失的,由甲方负责并承担责任Party A shall be responsible for any extra costs incurred due to his use of the property before the final co29、mpletion meeting and signing of the “Engineering Quality Acceptance” document.八、纠纷处理方式DISPUTES 1. 因工程质量双方发生争议时，凭本合同文本向有关行业协会申请调解，也可向所在区、县建设行政主管部门或消费者协会投诉 If there is a dispute between the parties, this contract should be submitted to the relevant trade association for mediation and also to the host 30、district and county building departments in charge of administrative complaints, or to consumer associations.2. 当事人不愿通过协商、调解解决、或协商、调解不成时，可以按照本合同约定向-上海仲裁委员会申请仲裁-人民法院提起诉讼 if, after negotiation, mediation and/or consultation, the parties have failed to reach an agreement, then the dispute should be:sub31、mitted to the-Shanghai Arbitration Commission-filed as a lawsuit.九、合同变更和解除AMENDMENT AND TERMINATION1.合同经双方签字生效后，双方必须严格遵守。任何一方要求变更合同内容或解除合约，由双方协商解决，经双方签字确认后生效 After this contract is signed it must be strictly adhered to. After the contract is signed, neither party can leave the contract without agree32、ment of the other party.2.本合同签订后，工程不得转包After this contract is signed, the project shall not be sub-contracted.3.本合同一式 两 份，甲、乙双方各执 1 份，合同附件为本合同的组成部分，具有同等的法律效力This contract will be printed and signed in duplicate and each party shall keep a copy.十、其它约定 FINAL CLAUSES1.如遇不可抗力因素，工期顺延In the event of force33、 majeure, this contract will be delayed and resume as soon as practicably possible.2.其他未在本合同内规定的事项双方协商解决If any matters arise which are not covered within this contract, they shall be dealt with by mutual consultation between the two parties. 十一、附件ANNEX 1.
