Gestampx Metal Forming (Wuhanx) Ltd. is fully committed to follow all legal labor requirements, and fully comply with Chinese health.1 1适用范围 Application Scope本手册就海斯坦普x金属成型(武汉17、x)有限公司(以下简称“海斯坦普x武汉x公司”或公司)的劳动条件及公司员工(以下简称“员工”)的工作职责做出规定。其他未在本手册里规定的事宜应按照海斯坦普x武汉x公司和员工签订的书面劳动合同的条款执行。海斯坦普x武汉x公司的员工应遵守本手册。This Employee Manual regulates the employment conditions and job responsibilities of employees of Gestampx Metal Forming(Wuhanx)Ltd. (GMF WUHANx or Company for short). The Employe18、e Manual is the basis of employment at GMF WUHANx. Additional and individual conditions are agreed upon in he written labor contract signed between the Company and every employee. All employees of GMF WUHANx must obey these rules.2 2雇佣程序 Employment2.1 根据中国法律规定,海斯坦普x武汉x公司作为一家外商独资企业拥有其相关的管理权限。公司有权按中国劳19、动法自行聘用和解雇员工或终止劳动合同。According to relevant Chinese Legislation, as a wholly-foreign owned enterprise, GMF WUHANx enjoys certain management rights. The Company has the right to employ and dismiss employees or terminate their labor contracts, restricted only by the Chinese labor law. 2.2 公司员工数及其任职要求由公司根20、据公司业务发展需要决定。According to the companys business and development, the management determines the number of employees and their required qualifications.2.3 试用期 Probation period试用期根据具体情况为1-6个月(根据劳动合同约定)。试用期届满,由员工上级完成试用期回顾并给予反馈。The probation period is 1 to 6 months, according to the individual situation (21、Based on labor contract). At the end of the probation period, the superior of this employee will review the probation development and provide feedback.2.4 公司应与每位员工签订个人劳动合同。The Company signs an individual labor contract with every employee.2.5 公司每年将免费给员工提供一次健康体检服务。The Company will provide the employe22、e a free medical check every year.2.6 员工需在上岗第一天提交下列文件的复印件一份;同时需查验原件。如果没有原件,需要提交经证明核准的复印件。Employees must submit the following items to GMF WUHANx at the 1st day of work. Documents must be presented in original and 1 copy. In cases where original documents are not on hand, certified copies must be pre23、sented.a) 与先前公司解除劳动合同的文件;A document confirming the termination of the labor contract with the previous company;b) 下列证书原件及复印件:学位证书、毕业证书、职业资格证书、特殊工种的操作证书、技术等级证书、外语等级证书、前公司公积金证明等;公司有权对证书进行核实;Certificates and its certified copies of the following documents: education or graduation certificates, employme24、nt certificates , specific machine operating certificates and technical skills certificates,foreign language certificates, housing fund information; The Company has right to check the authenticity of these certificates.c) 一份身份证或护照复印件;A passport or ID card photocopy;d) 体检报告Health report;e) 在海斯坦普x武汉x公25、司任职时或在海斯坦普x武汉x公司任职前,海斯坦普x武汉x公司可能要求的其他信息或文件。GMF WUHANx may request any other messages and documents before or during the employment of the employee.f) 根据需要将人事档案转到“武汉x光谷人才服务中心”的公司人事代理专户下。Transfer the official personnel registration record to Wuhanx East Lake HR Service Centre with the support of the C26、ompanys HR Dept if necessary.2.7 海斯坦普x武汉x公司会根据个人数据保护规定及公司员工个人档案管理的有关规定来负责收集、保持、处理和使用员工的个人资料。个人数据的收集权限于合法的以及与员工的聘用相关的目的,直接主管、部门经理、总经理有权了解这些资料。海斯坦普x武汉x公司将采取一切实际可行的措施以保证员工个人资料的安全性,并防止未经授权的人员接触,销毁或使用这些资料。GMF WUHANx will file, keep, handle and use the employees personal information according to the docum27、ent management rules and privacy protection regulation. The right to compile individual statistics is restricted by the law and can only be for purposes related to employment. Direct Supervisors, Department Managers and the General Manager have the right to see some of those documents. GMF WUHANx ta28、kes all the necessary measures to protect individual information and prevents unauthorized persons from accessing, removing or using this information.2.8 本手册将提供给员工每人一份。A copy of this manual is handed to every employee.2.9 每位员工应将下列任何事项的变动, 提交书面证明文件给人力资源部以更新员工信息:In case any of the following conditions29、 change, the employee should inform HR department of the change by submitting relevant documents:a) 合法送达地址;Legal contact address;b) 教育程度、资历证明;Level of education and qualification;c) 姓名;Surname and given name;d) 婚姻状况;Marriage status;e) 其它重要个人资料或事宜。Other important personal issues.3 3员工辞职(退)程序 Procedur30、e of leaving the Company3.1 员工提出离职,须提前三十日以书面形式通知公司。试用期内的员工提出离职,须提前三日以书面形式通知公司。 An employee may terminate his employment contract upon 30 days prior written notice to the company. During his probation period, an Employee may terminate his employment contract by giving the company three days prior not31、ice.3.2 如果员工离职,无论任何原因(劳动合同到期、员工提出或公司提出解除劳动合同)都必须履行正常的离职手续,包括把与工作相关的文件(含电子文件)上交给他/她的上司,归还公司的物品(手机、电脑、文具、洗净的工作服、劳保用品、工具等),并向他/她的上司或被上司指定的同事说明工作的进展状况。离职前确保所有交接工作完成,在完成程序的同时,填写离职流程表,取得相关人员及经理的签字同意,公司才为其办理其他离职手续。If an employee leaves the Company, no matter for what reason (e.g. expiration of labor contra32、ct, notice by the employee or by the Company to terminate the contract), he or she has to complete the proper leaving procedures. These include handing over all work-related documents (including electronic documents) to his or her superior, returning all Company objects that he or she may have used 33、during work (e.g. mobile phone, computer, stationary, the washed work uniform, safety items, tools etc.), and explaining the status of his or her work to his or her superior or a colleague designated by the superior. A proper and complete handover to a colleague or superior is an important matter wh34、en terminating the employment. After completing all these procedures, the employee should fill in and sign the Leaving Employee Checklist and submit it for approval by signature to his superior and relevant manager. Then Company can deal with the leaving procedures.4 劳动合同 Labor Contract本手册任何一条规定,如果与35、员工和海斯坦普x武汉x公司之间劳动合同不一致或有冲突,所涉及的员工的事宜应该遵照或服从劳动合同的条款执行。If there is a conflict between any of these rules in this manual and the labor contract signed between GMF WUHANx and the employee, the issue shall be handled according to the individual labor contract.5 公司规定 Company Regulations5.1 员工必须遵守海斯坦普x武汉x公36、司的规定,听从上级管理人员的工作要求,尽职尽责。The employees must obey the company regulations, follow the instructions and orders of their superiors, and fulfill their duties and responsibilities as best they can.5.2 上级管理人员必须正直地履行他们的职责,以宽厚和指导的方式领导其下属。Superiors must fulfill their responsibilities in a fair manner, manage 37、their subordinates in an honest and kind way and provide guidance to them.6 4遵守职责 Responsibilities of employees6.1 所有员工有同样的义务遵守本手册规定。All employees have the same duty to obey the rules in this manual.6.2 员工必须遵守下列事宜并且尽职尽责:The employees must fulfill their duties and responsibilities and act according t38、o the following arrangements:6.2.1 仪表端庄,注意个人卫生,注意安全,保持工作服的整洁,并按规定穿戴劳保用品。Be orderly and correct in their work, take care of personal hygiene and safety, keep the work uniform clean,and must wear PPE according to the relevant regulations.劳保用品 PPE防护目的 Protection purpose穿戴区域 Wearing Area安全眼镜Safety Glass39、es防止飞溅物、强光、化学液体及粉尘等对眼镜之侵害 Defend the eye from damage by spreading, strong light, chemical liquid, dust车间内任何区域Any place in the workshop安全鞋Safety Shoes防止脚部受压、砸、刺伤Defend the feet from squeeze,spur,squash车间内任何区域Any place in the workshop耳塞Ear plug防止85分贝以上的噪音危害Defend the head from hit by noise above 85 dB40、车间内任何区域Any place in the workshop安全帽Safety Hammer防止头部受到外来的坠落或飞行物面等撞击,防止电击危险等 Defend the head from hit by failing or flying bodies and electricity登高作业、行车吊装For climbing and crane operation口罩Mask防止粉尘及有害气体等污染物进入呼吸系统 Prevent the harmful air or dust from breath in打磨作业、手工焊、喷蜡、抛丸操作等 For grinding manual weldi41、ng, waxing operation, shot blasting手套Gloves防止机械与物料的刺/割伤害,化学品腐蚀伤害及触电伤害 Defend the hand from cut,spur,hurt by machines,parts,chemicals and electricity冲压作业(防穿刺手套)、焊接作业(焊工手套)、化学品接触作业(防水手套等) Spur defend for pressing Heat defend for welding, water defend for chemical touch安全带Safety belt防止坠落 Defend the bod42、y from failing离地2米以上登高Climbing above 2 meters围裙Apron防止焊接飞溅溅到身上或金属零件割伤身体 Defend the welding splash and sharp work piece from be hut冲压车间、焊接车间手工焊岗位Press and manual welding position工作服Uniform车间任何区域 Any place in the workshop 正确有效地履行职责,并且一直尽力提高其工作效率,保持积极的工作态度。在履行职责时,员工必须努力为公司的发展做出贡献,个人利益服从公司利益。Carry out t43、heir duties in a proper and efficient way and constantly aim to increase work efficiency, have an active work attitude. When fulfilling their duties, the employees must work diligently in order to make contributions to the development of the Company. Personal benefit comes after the Companys benefit44、.6.2.2 在履行职责时,员工应尊重海斯坦普x武汉x公司的政策,相互协作,积极努力推动业务顺利进行。When carrying out their duties, employees should respect GMF WUHANxs policy, support each other, and do their best to facilitate the successful development of the business.6.2.3 不要做有损海斯坦普x武汉x公司的荣誉和信誉的事情。Not do anything that might damage the reputati45、on and credit of GMF WUHANx.6.2.4 不要在授权之外武断专行。每位员工的授权范围在其工作范围及核准的技能中做了界定。Not do anything they are not authorized to do. The authorization scope of every employee is described in his job scope and approved skill level. 6.2.5 每位员工应遵守商业事务绝对保密的规定。合同、图纸等只可以在相关上级管理人员允许的情况下复印。不要透露公司商业机密或任何可能损害海斯坦普x武汉x公司的其他46、事情。Every employee shall respect the rule that business issues are strictly confidential. Documents such as contracts and drawings may only be copied with the relevant superiors permission. Do not disclose any confidential information on the Company or anything that might harmGMF WUHANx.6.2.6 除非与海斯坦普47、x武汉x公司的工作有关,否则在私人交易中不许使用海斯坦普x武汉x公司的名字。Apart from carrying out official GMF WUHANx work, the employee is not allowed to use GMF WUHANxs name for personal financial transactions.6.2.7 未经海斯坦普x武汉x公司允许,不得从海斯坦普x武汉x公司的商业联系人处接受金钱或向他们借钱;对于礼物,必须拒绝或退回,除非价值很小,不影响员工遵从海斯坦普x的经营目标及道德标准Without the permission of GMF 48、WUHANx, the employee is not allowed to accept monetary gifts or borrow money from business contact people of GMF WUHANx. The employee has to reject or return presents, except when they are of small value and do not harm the employees loyalty to Gestampxs business goals and ethical standard.6.2.8 未经上49、级管理人员批准,不许在工作时间离开工作场所。Except with the permission of the superior, the employee is not allowed to leave the work place during working hours.6.2.9 未经海斯坦普x武汉x公司的允许不得以雇员、承包商、管理人员或董事的名义为其它公司工作,也不允许从事可能影响海斯坦普x武汉x公司利益的私人业务。只有在公司事先允许的情况下,员工才能从事私人业务,第二份职业,或任何形式的其他业务。Without the permission of GMF WUHANx, the 50、employee must not work for other companies pretending to act on behalf of business partners, contractors, the management or directors of GMF WUHANx. The employee must not engage in personal business that might have an impact on GMF WUHANxs benefits. An employee is only allowed to have a private busi51、ness, secondary employment or ownership of any kind in another business if it has been permitted by the company. 6.2.10 保持工作场所整洁有序,尽力防止偷盗、火灾或其它损失,遵守有关卫生安全规定。The work place has to be kept clean and tidy. The utmost has to be done to prevent theft, fire, or other damages. The hygiene and safety regula52、tions have to be respected.6.2.11 保护好设施和装备以及其它海斯坦普x武汉x公司的财产、节约用水、电和文具用品等。Protect the facilities, equipment and other possessions of GMF WUHANx. Do not waste water, power or stationary etc.6.2.12 雇员不得在工作场所饮酒或滥用其他药物;并不得在醉酒或处于任何其它药物控制情况下开展工作。操作员工不允许在工位因个人目的使用手机。Employees are not permitted to consume al53、cohol or abuse other substances at the work place, and must not carry out their tasks when they are drunk or under the influence of any other drug / substance. The personal use of mobile phone is forbidden in shopfloor workstation.6.2.13 员工有什么抱怨,可以向上级管理人员或海斯坦普x武汉x公司总经理申述。If employees have any compla54、ints, they can appeal to their superior or the General Manager of GMF WUHANx.6.2.14 任何盗窃,损害公司财产,工作场所使用暴力,参与暴动的行为都需要承担相应的损失赔偿,严禁未经允许进行大规模集会,违反将可能导致其雇佣关系的终止。Theft, damage of company property, engaging in physical violence, participating in riots, organizing large meeting in the company without permit,55、 will trigger compensation claims and possible dismissal.7 5出勤 Attendance7.1 工作时间 Working Hours7.1.1 公司应该根据中国政府有关工作时间的规定,设立基本工作周的工作时间以达到充分的生产能力。The Company determines the working hours of the regular working week so that optimum production capacity is achieved. The working hours must be in line with56、 the relevant regulations of the Chinese Government.7.1.2 如无特殊原因,正常工作时间为每周40 小时,生产部员工的正常班次工作时间根据生产部的具体安排。工作时间始于员工开始正式工作(劳保用品,工作服穿戴完毕),工作时间结束于员工离开工作岗位。更换衣服,个人卫生,休息时间不视作工作时间。The normal working hours of staff and workers related to production are 40 hours a week. For the actual shift schedule refers to57、 the plan of the production department. The work time starts when the employee is ready to carry out his/her task, i.e. fully dressed in work uniform including necessary PPE. The work time ends when the employee leaves his/her job position and intends to terminate work for the day. Time spent in the58、 company for changing clothes, personal hygiene or rest are not work time.7.1.3 如遇特殊情况,如电力供应不足,公司将临时调整所有员工的工作时间,包括周末工作。In the event of exceptional circumstances, such as power shortage, the working hours of all employees can be temporarily adjusted accordingly, including work at the weekend.7.1.4 根据59、生产经营的需要或因为不可控情况,在遵守劳动法的前提下,公司可以改变部分或全部员工的工作时间表,包括周末工作。变动之后的工作时间表应成为员工正常的工作时间。If required by production needs or when uncontrollable circumstances occur, the company can change the time schedule of part of or all of the employees at any time, including work at the weekend, in line with the Labour Law60、. In this case, the changed working time schedule becomes the regular working schedule of the employees.7.2 加班程序 Overtime procedures7.2.1 公司可以按劳动法的相关规定与员工协商之后延长工作时间或加班。 除非双方另行书面同意,海斯坦普x武汉x公司应根据中国相关法律补休或支付加班工资,补偿方式由海斯坦普x武汉x公司决定。According to the relevant regulations of the Labour Law, the Company can 61、extend the working hours or arrange overtime after consulting with the employees. Except when a written agreement exists between the Company and the employee, GMF WUHANx compensates overtime by time off on another day, or by paying overtime compensation. GMF WUHANx decides on the compensation method62、, in accordance with the relevant legislation.7.2.2 凡法定假期的加班按国家标准支付加班费。Working overtime on legal holidays will be compensated according to the Labour Law.7.2.3 车间员工的平日及周末加班,由其主管在考勤系统内直接排班完成批准设置,车间员工排班8小时以上的时间将自动计为当日加班时间。办公室员工的平日及周末加班, 可填写加班休假申请单,由部门经理签字批准后,在考勤系统内完成加班设置The workers weekday and weekend63、 overtime will be directly scheduled by the superior. The workers attendance more than 8 hours will be accounted as overtime automatically. The staff can fill the Overtime and Leave Application Form and submit to department manager for overtime application, after the department manager approves it, 64、the superior should schedule it in Kronos.7.2.4 员工的当月加班排班超过36小时以上的加班,应首先由员工本人签字确认加班安排申请表,再由其上级根据员工确认的加班安排申请表进行排班。Before schedule a overtime which is more than 36 hours per months, the superior should get the Overtime Arrangement Application Form signed by the employees, and then schedule the attenda65、nce based on the employees agreement.7.2.5 员工在法定节日加班,应事先填写加班计划表交部门经理及总经理批准后。再由其上级根据批准的加班计划表进行排班。 For the over time on National festival, the employee needs to fill the Overtime Plan Form and submit to department manager and General manager approval, and then schedule it based on the approval Overtim66、e Plan Form.7.2.6 员工的平日加班首先冲抵无薪缺勤,再根据当月理论工时统计平日加班小时。周末加班小时及有薪假期均不受影响。The overtime on weekday will firstly offset the absent hour, then use the rest part to calculate the overtime based on theory hour. For the government regulatory annual leave days that the employee havent applied in the year, the company should arrange the leave days or pay a 300% equivalent daily salary.8.3 特殊请假 87、Leave because of Special Circumstances8.3.1 病假 Sick Leave员工请病假时必须持有公司认可医院的相关病休证明,如果发生急诊必须当天早上得到上级主管和人力资源部的电话同意,待开始上班后的第一天补办病假手续,否则按旷工处理。When applying for sick leave, the employee has to present a certificate about his or her illness and treatment from a Company-approved hospital. If the employee sud88、denly falls ill, he or she has to inform his or her superior and the HR Dept. by phone and get their approval in the morning of the first sick day. Leave without pay is restricted to 30 days every year.8.3.8 公司安排缺勤 Absence arranged by company根据生产和运营状况,由公司安排的休假称之为公司安排缺勤,公司安排缺勤属于无薪假。在公司安排缺勤的情况下,员工当月的总工资(扣除保险个人部分和个人所得税之前)低于当地最低工资标准,公司按照当地最低工资标准支付According to the operation situation, the company can arrange employee absence, and the comp102、any arranged absence is an un-paid leave. When the employee salary is lower than the local minimum salary due to absence arranged by company, the company will pay the salary at the local minimum salary.9 7薪酬 Compensation9.1 员工薪酬由海斯坦普x武汉x公司根据员工的工作岗位、表现、效率、特长等自行决定。The compensation (salary or wages) of103、 every employee is decided by GMF WUHANx according to the position, performance, efficiency and special skills of the individual employee.9.2 公司在遵守劳动法的前提下可根据整体市场及经济状况、公司表现、员工个人绩效评估等因素决定调薪的数额及幅度。The Company can adjust an employees compensation according to the market and economic situation, the perfo104、rmance of the Company and the performance appraisal of the individual employee, in accordance with the Chinese Labor Law.9.3 每月工资计算时间从当月首日至当月最后一日 。每月的第十天为上月薪酬的支付日。The salary calculation period is from the 1st day to the last day of current month, and the current month salary will be paid until the 1105、0th day of next month.9.4 工资中的自动扣款 Automatic deductions9.4.1 社会福利(包括养老金、医疗保险金、工伤保险、失业保险、生育保险和住房公积金等)以及所得税的个人承担部分,以及其他公司依照劳动合同或手册制度可以扣除的费用,公司会安排在每月薪金中自动扣除,并统一向各有关当局呈报。The Company deducts the amounts for social insurances (including pension, health, and industrial injury, unemployment insurances, proc106、reate insurance and housing fund), and the employees share of the individual income tax from the employees monthly salary and effects the payments to the relevant authorities.9.4.2 员工在15日之前(含15日)入职,则公司从当月起为其办理社保和住房公积金,15日之后入职,则从下月起为其办理社保和住房公积金。If the employee onboard before 15th of the month (includ107、ing 15th), the company will pay the social insurance and housing fund from the concurrent month; if the employee onboard after 15th of the month, the company will pay the social insurance and housing fund in the next month. 9.4.3 员工在15日之前(含15日)离职,则公司在当月为其办理停保和停缴住房公积金,15日之后离职,则在下月为其办理停保和停缴住房公积金。If th108、e employee leaves before 15th of the month (including 15th), the company will stop the social insurance and housing fund from the concurrent month; if the employee leave after 15th of the month, the company will stop the social insurance and housing fund in the next month. 9.5 如果员工发现其收入计算有错误,应该立即通知人109、力资源部。If an employee notices a mistake in the calculation of his salary or wages, he or she should inform the HR Department immediately.9.6 薪酬是保密信息,严禁私下沟通、打听、传播薪金信息;The compensation is confidential data. the company reserves the right to legal actionU. 不按作业指导书操作,造成人员严重受伤或5000元以上经济损失 Not comply to the safety o159、peration procedure requirement, make an accident with loss more than RMB 5 000 or severe people injuryV 酒后上班 Work after drink alcoholW. 违反财务、人事、采购操作流程,导致5000元以上直接或间接损失,对工作或公司声誉产生严重影响 Violate Finance, HR, Purchase operation process , cause a loss of over RMB 5000 and harm company reputation badly X.未160、经申报,利用职务之便,以获得折扣或帮助的形式从客户或供应商处谋取500元以上个人利益 Not declare, take advantage of the position to get discount or personal interests over RMB 500 from supplier or client12.3.4 四类违纪 Category 4 of rule violationA.蓄意违反安全或操作规定,给公司造成严重后果或经济损失Intentionally violate the safety and operation rules, and make serious 161、result or loss to the companyB.一个月内旷工三天及以上 Miss for work for not less than 3 days in a monthC.对客户、同事或他人进行性骚扰、或使用身体侵害行为 Make sexual harassment or physically harm to colleagues, customers or other third partyD.在公司场地内挑拨或参与打架斗殴事件 Incite other people to fight or engaged in fighting in the company E.在工作时间162、和工作场所内喝酒 Drink alcohol in working time and working place.F.对同事、同事家属、客户进行恐吓、暴力或敲诈 Threat, stalk and harm physically colleagues and/or a colleagues family, customer or other significant 3rd partyG.在对外进行业务交往时违反本手册第6.2.8条规定,行贿受贿,接受价值500元以上财物及服务 Violate the employment rule 6.2.8,make bribery, to receive 163、benefits or service of more than RMB500 during the association with external parties H.违反公司保密规定,窃取或泄漏公司产品报价、采购成本、员工薪资、财务数据、技术信息等机密 Violate the company non-disclosure rules, steal or release the confidential information or files, such as product price, purchase cost, employee salary, financial data, 164、technical information and files, etcI.未经允许,使用个人USB拷贝公司保密资料 Use personal USB to copy company confidential files without permissionJ.伪造发票或文件等以达到欺诈目的 Forge receipts or files on a cheating purposeK.提供虚假信息以获得工作职位 Provide false information to get a jobL.参与偷盗公司财物或他人财物 Engaged in stealing company or employe165、e materialsM.因失职或违反操作规程,造成人员伤亡或10000元以上经济损失 Because of neglecting the duty or not respecting the rules, create an accident with a loss of more than RMB 10000 or people injury or deathN.使用或参与贩卖任何类型的毒品 Use drugs or engaged in trading drugs any timeO.任何方式的纵火行为 Any types of fire settingP.使用未经认可或非法的计算机软件166、,给公司造成严重后果 Use unlicensed or pirated software and make serious result to the companyQ.违反国家或地方刑法法规 Violate the criminal law inside the companys perimetersR.挑拨、或鼓动、或参与非法罢工 Incite, encourage or engaged in illegal strikeS.违反6.2.10规定,未经公司批准在外兼职工作,并拒绝纠正的 Violate the 6.2.10 rule and undertake a job in addi167、tion to his/her position without companys permit and refuse to correct itT.员工本人或其直系亲属以投资、合作方式参与供应商或客户的经营管理 Employee or their indirect relatives invest in or cooperate with supplier or client and take part in their management and business12.4 违纪处罚方法 Penalty for rule violation处分类别Category of penalty处罚168、方法Penalty rules口头警告Oral warning在年终奖中扣除50至100元罚款Deduct a fine of RMB50 - 100 in the annual bonus 书面警告Written warning在年终奖中扣除100至300元罚款取消当月绩效奖金Deduct a fine of RMB100 300 in the annual bonusDeduct concurrent monthly bonus 严重警告Serious warning在年终奖中扣除300至500元罚款取消当月绩效奖金。Deduct a fine of RMB300 500 in the a169、nnual bonus Deduct concurrent monthly bonus违纪辞退Termniation of Labor contract公司有权依法予以解雇, 解除其劳动合同,并不给予任何经济补偿。(该处罚不适用于迟到和吸烟违纪)The company has the right to terminate the labor contract without any compensation for labor contract termination (this penalty is not applicable for rule violation of being lat170、e for work and smoking)12.5 员工行为纠正 Correction of employee behavior12.5.1 员工受到警告后,应立即对违纪行为加以改正。The employee should correct his/her wrong behavior after receiving the warning.12.5.2 若员工在受到处分后没有再发生违纪行为,则,口头警告在3个月后自动撤销,书面警告在6个月后自动撤销,严重警告在12个月后自动撤销。 If the employee doesnt make any violation after receivi171、ng the warning, then, the oral warning will be deleted after 3 months passed, the written warning will be deleted after 6 months passed, and the serious warning will be deleted after 12 months passed13 11申诉权 Right of Petition13.1 被处分的员工有权对认为不公平的处分在程序的任何阶段进行申诉;申诉按如下程序进行:Employees who are punished hav172、e the right to petition against punishment they find unfairness at any stage of the procedure. The petition must follow the procedures below:13.1.1 员工首先与部门负责人会谈。The employee first of all discusses the issue with the responsible person from his or her department.13.1.2 如部门负责人不能解决问题,应以书面转呈人力资源部,仍不能解决问173、题,可书面呈报总经理。If the responsible person from the department is unable to solve the problem, the employee should submit a written report to the HR department. If the HR department is not able to solve the problem, a written report could be submitted to the General Manager.13.1.3 公司人力资源部根据调查核实的情况,对员工的申诉给174、予书面答复。After checking the matter and verifying the circumstances, the HR Department should produce a written reply to the employees petition.13.2 如员工对公司所给予的书面答复(或处分)不满意,可以向劳动仲裁委员会申请劳动仲裁;对仲裁不服的,可向法院诉讼,但在有关部门未做出改变原处分的决定以前,仍按照原处分执行,同时可暂时停止该员工工作。If the employee is not satisfied with the written reply (or175、 punishment) made by the Company, he or she can apply for arbitration at the labor arbitration committee. Those employees who refuse arbitration can open a lawsuit in a court.
