When being recruited, the employee should read and fully understand the context;Both the company and the employee shall obey the principle of Employment Management of Guangzhou”四、人事资料 Personnel data(1)所15、有在你就职前后提供的,作为你被公司雇佣的个人档案资料将由行政人事部存档。这些内容是保密的,查阅是受限制的。任何不填的项目或错误的陈述将有可能受到行政处罚包括辞退All the information that you provided will be filed by HR & Admin. Department. These files are confidential, any counsel is limited. Any misleading or untrue declaration given by you may lead to punishment or even dismis16、sal(2)入职时填报的以下个人资料如有变更,必须在变更后七日内以书面形式知会人力资源部更新。如因员工未及时通知而导致的任何延误,一切责任由员工自负。Should any following information change, within 7 days you are to inform the HR & Admin Dept .on the appropriate from, any cost caused by delay shall be charged to the employee.(a)名 字 的 更 改 Change of name.(b)身份证号码的改变 Change o17、f ID card number(c)联系地址、电话号码的改变 Change of your contact address or telephone number(d)紧急事件联系人姓名和电话号码的更改 Change of the name & phone number of your emergency contact person(e)获得其它教育专业资格New certification Obtained from further education(f)个人技能的获得如驾车、急救等Acquired personal skill, such as driving license, fi18、rst aid.etc.,(g)工资银行卡号码的更改Change of the payroll account合适的支持文件,同样应该上交。Relative supporting documents shall also be provided.五、试用与转正Probation Period and Confirmation51试用期限Probation Period员工试用期一般为两个月,视工作表现和情况需要可缩短或延长,但不应少于一个月或超过六个月。试用期间,部门主管将员工的工作表现进行评估。Except in special case, all new employees will ha19、ve a probation period. not exceeding 6 6 months During the probation period, an appropriate performance evaluation shall be conduct by your department head.如在试用期内表现符合公司要求,试用期届满时将获正式的书面通知书。If your performance during the probation period meets the company requirement during the probation period, the e20、mployees shall receive a formal confirmation letter from the company on the probation expiration. 所有合约员工在试用期内,品行欠佳、工作态度不良、对公司有不满情绪、非因工而患有重疾病或传染病者,公司有权对其即时辞退;员工如在试用期内发现不适应公司得工作环境和条件,也有辞退离开公司得权利。 对于不能通过试用期考核或表现未通过公司要求者,公司有权终止劳动合同,解除劳动关系。If your performance during the probation period can not meet the 21、requirement of the company, then the company may require to extent your probation or terminate the employment offer with you, a formal written notice will be issued to you.52转正程序新员工试用期届满前15天,由人事行政部向用人部门发出员工转正表和试用人员转正考评表。部门负责人收到员工转正表后,先发放到员工手上让员工进行自我总结后再交由部门负责人连同试用人员转正考评表一起对员工进行考评,填写转正意见,交到人事行政部。如在此期22、间因员工本人或部门负责人因延迟交表而造成一切后果由当事人负责。人事行政经理收到审批意见后,正式办理员工转正或辞退事宜。53转正或辞退手续办理 如同意该员工转正,则按要求办理转正手续; 需延长试用期的,则由人事行政部向该员工发出延长试用期通知书; 需辞退的,则办理辞退手续;从辞退之日起,被辞退人员与本公司的劳动关系自动终止,本公司停止为其办理社会保险事宜。 员工经审批被正式录用的,由人事行政部通知员工本人以示确认,同时员工入职时签订的劳动合同正式生效。六、晋升、降职、调岗、调薪 Promote, Demote, Position moved, Salary adjustment公司将根据员工的工23、作绩效、岗位能力素质要求及岗位空缺情况给对员工岗位、工资及职务做出相应的调整。The company shall be adjust your position and salary upon fall assessment of your skills, ability and performance 因工作需要,员工转换岗位按以下程度:61普通员工的转职/升职,由部门负责人填好职位变动申请表里的转职/升职理由,员工工作表现及相关技能说明,报人事行政部审核后发出部门调动通知书到员工本人62管理级别员工的转职/升职,需要人事行政经理对其员工的工作表现及所能达到的技能水平评估后由经理审批63员工24、转换或提升到新职位通过两个月试用期后,其主管需作表现评估,以决定该员工是否适合新职位,若评估结果表明不符合职位要求,需重新作岗位调动。七、解除劳动合同 Contract Termination71在劳动合同期内,公司可对下列员工解除合同,具体手续按有关管理规定办理。During the employment period, the company shall terminate your employment,according to relevant procedure of the relative management regulation.(1) 表现欠佳,经警告、培训、调整岗位仍不能25、胜任工作的;You employee can not work well, even after warning & training have been given.(2) 员工患病或非因工负伤,医疗期满后不能从事原工作的;You employee contracts a disease or become wounded and after a statutory medical treatment period still can not perform your original role(3) 因客观原因导致原合同无法履行,经协商未达成一致的。The contract can not26、 be execute for objective reasons, and cannot reach an agreement after negotiation72公司员工有下列情形之一,经查证属实者,立即给予解雇,并不付任何经济补偿。1)对领导给予的批评、教育采取谩骂、人身攻击或有威胁、殴打行为者,从而扰乱了生产、工作和生活秩序2)在公司内外有意怠工,不服从上司的合理工作安排,无理取闹、聚众闹事、打架斗殴、影响生产秩序、工作秩序者。打人致伤者必须负担受伤者一切费用和损失,如用利器打架的报公安机关3)玩忽职守,违反技术操作规程和安全规定,或违章指挥,造成事故,使人身财产遭受较大损失者4)造27、谣生事,散播谣言,煽动闹事,谎报案情、灾情,制造混乱,造成严重后果者;5)组织、煽动怠工,或采取不正当手段要挟领导,严惩扰乱公司秩序者6)利用公司名义在外招摇撞骗,以致公司名誉蒙受重大损失者。7)蓄意损坏公司或他人财物,故意泄漏技术、营业之秘密,致使公司蒙受损害者。8)对上级或同事实施暴行或有重大侮辱之行为者9)违反劳动合同或工作规则情节严重或经常违反公司规定屡教不改者10)擅离职守,导致事故,使公司蒙受重大损失者11)泄漏生产或业务上机密者12)在工作中酗酒滋事妨害生产秩序者13)依合同约定调派工作,无故拒绝接受者14)因行为不当,公司无法再对其信任者15)在厂内有伤风化行为者16)伪造资料28、(如假生产记录,假签名)或擅自变更工作方法或提供虚假个人资料、证明文件、学历、介绍信、虚报人事记录,使本公司误信而遭受损害者17)其他重大过失或不当行为,导致严重后果者18)私拆设备、产品,盗窃公、私财物价值500元以上者(驾驶员为其提供方便的按盗窃论);19)诈骗公、私财物500元以上的者;20)因工作失职造成公司损失达5000元以上者21)对来宾言语或行为轻浮不当或粗暴无礼者22)对来宾索取好处及贪小便宜或故意刁难者23)代替他人打卡或接受他人代打卡者24)在一个月内连续旷工三天或累计旷工三天以上(含三天)者25)赌博或为赌博提供条件者26)在禁烟区内吸烟或引火者。27)私取或伪造公章、证29、明、证件以及未办手续私自刻制公章者;28)违反国家枪支、刀具管理规定,非法制造、贩卖、携带枪支或匕首、三棱刀、弹簧刀等管制品者;29)任何触犯中华人民共和国刑法的行为者。73 员工及公司均可按指定通知期或通知金代替通知期而终止劳动合同工作期通知期通知金代通知期试用期内7日通知期以聘用书中员工的日薪为基准。乘以所欠通知期天数作为代通知金。试用期后1个月通知期以解除劳动合同前1个月,员工的日新为基数,乘以所欠通知天数作为代通知金。凡自愿辞职的员工,必须按规定提前填写员工离职申请表经部门主管和人事行政部批准后方可离职。员工辞退/辞职均需在办理离职手续时填写离职交接清单,员工离职前应将公司交付使用或保30、管的物品、工具、公司资料等交还给公司,并按照与公司所签订的协议承担应尽义务。注:1) 正式员工应于一个月前提出书面申请,试用期员工则需提前一周提出书面申请;2) 试用期间如工作日不满七天。请辞者将不予以工资结算;3) 如正式员工在劳动合同的服务年限期间离职的,应按合同规定的违约金金额进行赔偿。 八、工作移交 Working Handover员工在离职前应办妥离职手续,包括财务清理帐目,移交工作、交还相关工作文件,磁盘、工具、名片、工作证等方可获工资结算及离开公司。 Final payment and leaving shall not be permitted until you have h31、anded over all related works, including financial settlement, working handover, returned relative documents, disks, tools, business name card, name tag etc. 第三章 员工薪酬制度Chapter 3 Salary System一、薪酬结构Structure of salary 公司根据级别架构支付工资,各个不同级别都有不同的工资标准,薪酬由基本工资及津贴构成。The company pays a salary according to its32、 payroll structure; there are different levels to different grades. The salary is consists of a basic salary and allowances.公司将根据员工的教育、技术水平、经验,工作责任等决定工资。 The salary will be set according to your education degree, technical skills, working experience and working duty, etc.保险包括养老保险、医疗保险、失业保险、生育保险、工伤保险33、等。 The insurance includes pension, medical, unemployment, birth control, working injury etc.员工必须按国家规定自行负担个人所得税及社会保险中的个人缴费部分,并由公司在工资中予以代扣代缴。You employees shall be responsible for part of the individual tax and relative insurance expenses according to statutory regulation; it will be deducted from you34、r monthly salary.2. 发薪方式 Salary Payment 工资于每月的固定日期,由银行转帐存入员工银行帐户。Pay day shall be on one the fixed day of every month, the salary will be transferred by bank into your bank account.3. 薪酬保密Confidentiality of the salary 公司为员工的薪酬保密,员工应对自己的薪酬信息保密,不得泄露自己的薪酬信息,亦不得打听和传播他人的薪酬信息,如有违反,公司将对员工进行扣罚100元工资处理,严重者给予35、辞退处理。Both you and the company shall keep the salary information confidentially.You should not release your salary information to others, should not inquire or disseminate any salary information of other employees. Any violation will be subject to a fine of RMB100.00 form your salary or dismissal for36、 seriously violation.4工资调整 Salary adjustment公司将根据物价指数、同行业工资水平、公司生产经营情况及员工的工作表现等因素,原则上每年对员工工资级别和个人工资进行一年一调整。The company will review/adjust the salary once a year according to the market price index, salary level, the P&L of the company and youre working performance .5. 年终双薪(第13个月薪金) Double pay ( 13th37、 month salary )公司在营利情况下,员工于本公司服务满一年(1月1日至12月31日),在中国农历前一周享受当年双薪。如果员工服务期满3个月不足一年的,可按以月为单位按比例享受部分的年终双薪。All employees with a continuous service for one whole year (From Jan. 1st to Dec 31st) . A yearly double pay will be issued according to the yearly P&L performance of the company, payable one week be38、fore CNY. For employees who have worked for the company more than 3 months shall be entitled to double pay according the ratio of actual working month.6年终奖 Annual bonus 年终奖的发放根据公司该年度的实际经营情况,效益情况及员工的个人工作表现而定, 其金额及发放日期将由公司决定。. A yearly bonus will be issued according to the yearly P&L performance of th39、e company and the working performance of the employees, the amount and the issue day will be adjusted by company.第四章 工作时间与假期Chapter 4 Working Hours & Holidays一工作时间 Working hour1 1公司办公室员工实行长短周工作制,长周工作五天半,短周工作五天。 The office working time of the company shall be a long/short week alternate, five and a h40、alf day for the long week, five days for the short week公司生产部员工实行七天工作制。 The production working time of the company shall be seven days a week1 2公司每天工作8小时。(不包括60分钟的用餐休息时间)8 hours every working day (exclude 60 minutes lunch time)13工作时间与考勤: Normal working hour and attendance record:工作部门Work Department工作41、时间working hour上班Work start午餐休息时间Lunch time下班Work finish办公室员工Officer8:30AM12:00PM-13:00PM17:30PM14工作时间调整 Working Hour Adjustment公司有权根据生产实际需要或意外情况对工作时间进行调整。The company is entitled to adjust the working hour according to actually production requirement or when unexpected accident happened.如:因政府部门供电不足而致42、在正常工作日不能生产,公司将相应安排员工在工作日调休,而在休息日或假日补上班。e.g. If electricity Supply Department stop power supply on workday, the company is titled arrange employees rest at workday, and compensate work on weekend or holiday.15加班 Over-time working151只有在绝对必须的情况下才可获准加班。加班必须先获部门主管书面批准。加班的时间必须在发生加班的当月考勤统计中结清。未经申请和事先批准的加班,43、公司不予承认。Overtime working will only be permitted when absolutely necessary. Working over time must be approved in writing by the Dept. head beforehand. The time for overtime working shall count in the current attendance record. Working overtime without any approval shall be regarded as null and will n44、ot be compensated 152星期六或星期天加班安排作调休处理。调休的申请,在递交申请表给行政人事部之前应得到部门主管的批准。Over time working on Saturday or Sunday shall be compensated by leave. Compensation leave application must be approved by the department head before submitting the form to HR & Administration Department. 153办公室人员及主任级以上管理人员加班作调休处理。O45、ffice staff and over supervisor level management over time working shall be compensated by leave.154对班后加班的员工,将安排补休或按政府有关规定发放加班工资。 Over time working after a day off shall be compensated by leave or by overtime payment according to the relative statutory regulation.155公司有权根据运作效率和业务需要调整工作时间及休息日的安排。The 46、company shall be entitle to adjust the working time according to the operational efficiency and business requirement156因生产制造或特殊岗位(如保安)之连续性,依实际所需担任轮班。157加班工资按下列情况计算:工作日加班加班工时X小时工资率X150休息日加班加班工时X小时工资率X200法定日加班加班工时X小时工资率X300(日薪):小时工资率日基本工资/8(月薪):小时工资率月基本工资/22/8二、假期Holidays21年假Annual leaves一般员工进入公司过试用期后47、每年可享受有薪年假为6天(其中三天由公司安排于农历春节统一休),每工作满一年增加一天,最多不超过10天。Employees entitled to 6 days paid annual leave per year after probation period (3 days fix arranged on CNY), having worked for the company more than 1 year will be entitled to 1 day added for each full year worked, up to a maximum annual leave of n48、ot more than 10 days in total主任级员工每年可享受有薪年假为8天,每工作满一年增加一天,最多不超过12天。 Employees entitled to 8 days paid annual leave per year, having worked for the company more than 1 year will be entitled to 1 day added for each full year worked, up to a maximum annual leave of not more than 10 days in total经理级员工,每49、年可享受有薪年假为10天,每工作满一年增加一天,最多不超过14天。Employees at manager level will be entitled to 10 days paid holiday per year, managers working for the company more than 1 year will be entitled to 1 day added for each full year worked, up to a maximum annual leave of not more than 14 days total试用期视为服务年限的一部分,但试用期内不能50、申请年假。The probation period shall be count as the working period with the company, but employees under probation can not apply for annual leave.年假的申请,在递交申请表给行政人事部之前应得到部门主管的批准。All annual leave application must be approved by the department head before submitting the form to HR & Administration Departme51、nt. 年假原则上不允许预支。 Taking annual leave in advance shall not be permitted.每年年假在12月31日后将不能累积,将会失效。没有提前足够时间申请,不能休年假。Annual leave not taken by the end of December will not accumulate and will expire.Annual leave may not be granted if insufficient notice is given.休息1天 提前2天通知1 day leave: 2 days notice休息2 -3天52、 提前5天通知2-3 days leave: 5 days notice 休息4 -6天 提前2周通知4-6 days leave: 2 weeks notice休息7天以上 提前3周通知Over 7 days 3 weeks notice年假不能代替辞职的通知期,在辞职通知已经上交后,任何的年假申请就不会被考虑。在你离开公司时,公司将会以工资形式支付,你未享用的年假。Annual leave can not be taken as the notice period replacement. Annual leave application will not be considered af53、ter the resignation notice has been submitted. The outstanding annual leave will be paid with the final salary by Company.22法定休假 Holiday所有员工将有权享受每年8天的节假日,即:All employees shall be enjoy 8 days holidays in every year:元旦1天 New Year Day 1 day 1st of Jan. 春节3天 Chinese New Year Day 3 days Lunar 1st3rd劳动节354、天 Labor Day 1 day 1st of May国庆节3天 National Day 1 day 1st of Oct. 23婚假/丧假1)工作人员本人结婚或工作人员的直系亲属(父母、岳父母、公婆、配偶及子女)死亡时,给予一至三天婚丧假; 2)工作人员结婚时双方不在一起工作的、以及工作人员在外地的直系亲属死亡时,可根据路程远近,适当给予路程假;3)工作人员晚婚(男25周岁、女23周岁以上登记初婚的),除按规定享受婚假外,另增加婚假7天。夫妻双方谁达到晚婚年龄谁享受。晚育的,男方护理假7天;4)工作人员在批准的婚、丧假期间,工资照发。往返途中的车船费等,由工作人员自理。23产假/哺乳假/55、流产假/看护假Maternity Leave/Lactation Leave/Misbirth Leave/Foster care Leave 1)产假假期,女职工产假为90天,其中产前休假15天,难产的增加产假15天。多胞胎生育的,每多生育一个婴儿,增加产假15天;女职工怀孕不满四个月流产的,应根据医务部门的意见,给予15天的产假,怀孕满四个月以上流产的,给予42天产假。 2)对晚育(指女24周岁生育第一胎的)并领取独生子女证的,可在法定基础上增加产假60天;难产的另增加产假15天。3)产假期间按出勤对待,工资照发,不影响评先进。4)晚育的男方有7天的护理假(包括节假日和公休日)5)有不满一56、周岁婴儿的女职工,其所在单位应当在每班劳动时间内给予两次哺乳(含人工喂养时间),每次30分钟。多胞胎生育的,每多哺乳一个婴儿,每次哺乳时间增加30分钟。女职工每班劳动时间内的两次哺乳时间,可以合并使用。哺乳时间和在本单位内哺乳往返途中的时间,算作劳动时间。3.4 事假Personal leave事假适用于员工遇特殊事件而无剩余年假的情况下申请,公司不鼓励员工申请此类假期,如有特殊理由或需要,应事先获部门主管批准.事假为无薪假期。Personal leave shall be for employee who meet special affair but fall short of annua57、l leave, this kind of leave is not encouraged. Personal leave must get appropriate approval in advance by Dept. head.
